Terms of Service

These terms govern your use of CaterIQ, operated by Hosted by Howell LLC. We wrote them to match how the product actually works today.

1. Acceptance of Terms
By creating an account or using CaterIQ at cateriq.ai, you agree to these Terms of Service. If you do not agree, do not use the platform. These terms apply to all users, including beta users, invited users, and customers on paid plans.
2. What CaterIQ Does
CaterIQ is a software platform for independent caterers. It provides tools for proposal creation and revision, recipe and menu costing, ingredient and menu management, AI-assisted imports, and related business operations. Some features use artificial intelligence, including third-party AI models such as Anthropic Claude, to generate or transform content.
3. Your Account
You are responsible for maintaining the security of your account credentials and for activity that occurs under your account. You agree to provide accurate information when creating and maintaining your account. You may not share your account with others or create accounts on behalf of third parties without their consent. CaterIQ may suspend or terminate accounts that violate these terms.
4. AI-Generated Content
CaterIQ uses AI to generate proposal text, parse uploaded files, and assist with other tasks. AI-generated output is provided as a starting point. You are responsible for reviewing, editing, and verifying all output before sending it to clients or using it for business decisions. CaterIQ does not guarantee the accuracy, completeness, or fitness of AI-generated content for any specific purpose.
5. Your Data
You retain ownership of the data you submit to CaterIQ, including ingredient costs, recipes, menu items, proposals, and client information. CaterIQ does not sell your data. Your data is stored in a shared system but isolated from other users by access controls and row-level security. We may use anonymized and aggregated data to operate and improve the platform.
6. Uploaded Content
You may upload invoices, receipts, menus, images, and other documents for CaterIQ features. By uploading content, you confirm that you have the right to share it with the platform and with the service providers used to operate that feature. Do not upload highly sensitive personal information unless it is genuinely necessary for the intended workflow.
7. Fair Use and Usage Limits
CaterIQ may enforce plan-based feature limits, usage caps, and short-window rate limits to keep the platform reliable and prevent abuse. Some limits differ by trial status or paid plan. Current plan details may be shown in the app, pricing page, or checkout flow, and we may update them over time.
8. Beta Access
CaterIQ remains an evolving product, and some features may still be described or offered as beta. Features may change, be added, or be removed over time. During beta periods, you may encounter bugs, downtime, or unfinished behavior. We appreciate feedback, but beta access does not guarantee future pricing or feature availability.
9. Payments and Subscriptions
Paid subscriptions are available for selected CaterIQ plans. Billing is processed by Stripe. Prices, billing intervals, and any discounts are shown on the pricing page and at checkout. Paid plans renew automatically until canceled. You can manage billing from the app settings or Stripe billing portal. Free trials do not auto-convert into paid subscriptions because no payment method is collected during trial signup. Billing begins only if you choose a paid plan through checkout. Except where required by law, fees are non-refundable once charged.
10. Prohibited Use
You may not use CaterIQ to violate any applicable law, submit fraudulent or misleading information, interfere with the platform, attempt unauthorized access, scrape or reverse-engineer the service, or generate content that is deceptive or harmful to clients or the public.
11. Intellectual Property
CaterIQ's software, design, branding, and underlying systems are owned by Hosted by Howell LLC unless otherwise stated. You may not copy, reproduce, or redistribute the platform or its protected materials without permission. Your own uploaded data remains yours, and AI-generated output created from your inputs is yours to use in your business.
12. Limitation of Liability
CaterIQ is provided as is and as available, without warranties of any kind to the fullest extent permitted by law. To the maximum extent permitted by law, Hosted by Howell LLC is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability for any claim will not exceed the amount you paid us in the 12 months before the claim.
13. Changes to These Terms
We may update these terms from time to time. We will post the updated version in the app or on our site, and for material changes we may also provide email or in-app notice. Continued use of CaterIQ after the updated terms take effect means you accept them.
14. Governing Law
These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Any disputes arising from these terms or your use of CaterIQ will be resolved in the state or federal courts located in or serving Lehigh County, Pennsylvania, unless applicable law requires otherwise.
